Second, I sincerely hope you are not in law school because if you are you will surely fail the exams and get kicked out anyway. While being able to say what you want, within reason, is permitted under the 1st Amendment, constitutional law doesn’t apply in this case. If you’re going to patronize someone get you facts straight. The ability of the HOA to refuse a flag pole is in property law. Feel free to respond with any questions. (fyi, I AM a law student and an officer of my chapter of the Federalist Society)

        Agreed, freedom of speech can be taken away from “private” domains such as HOA. This can be looked at in property law or conlaw. Specifically, the right to put a flag up can be overruled by statutes (hoa association)because it deals with a private entity. I still think its foolish to ban such a thing, it would be reasonable to ban the size of the flag as I would not want to live next to a house that was flying a flag as big as one flown at Perkins or stretched out at an nfl game.

      The right to be patriotic is a freedom. Liberalism and socialism are ideologies that focus entirely (albeit too much) on allowing someone their due freedoms.

      Conservatism is more authoritarian and limits freedoms. You’re thinking of FASCISM, which is an extension of Conservatism in the same sense that Socialism is an extension of Liberalism.

      If every liberal is a socialist loving, America hating traitor, then every conservative is a fascist loving, Hitler loving redneck.

Ronald Dworkin would argue that this right is due to the moral reading of the Constitution and the Bill of Rights. This moral interpretation of the Constitution, which may be slightly liberal, allows for abstract statutes to be applied to modern cases. Your dumb, c*unt ass would be something like a strict constructionist. This theory of jurisprudence takes the statutes quite literally and no one respects this because it is dumb as f*uck.

      To straghten everyone out, here are the bare bones basics of the major political and econmic theories in the world today (Please excuse the typos):
      -Socialism= A eocnomic theory as well as a political theory that includes first a revolution that eliminates the ruling class and creates a classless society that has no want or need of personal property. Seizure of all resources and are are controlled and distrubuted by the state. All people work for the common cause of supporting society. subsequently the good of the state > good of the individual. According to the Marxism theory this is a transitional stage to Communism. The removing of the needs of the individual.

      -Comunism= All resources are controlled and distrubuted by the state. All people work for the common cause of supporting soceity. subsequently the good of the state > good of the indi individualviual again. from some point the adminstrative bodies controling the resouces would be replaced by a smaller decentralized government spreads power around the state(Russia semi made it to that close to do it).

      -Fascism= is hard to define becuase it has many definitions (through time and people), but it is a authortian style government that has control of the private sector of the economy. Its polices are not left and not right and outside of post WWI and WWII really little examples of the largescale economies. I will say it attracts the far and extreme right but that is not and exculsive this political idealist. Its by some a social democracy were as the people have the right to control government unlike in comunism but they are themselves have little to no private property or enterprise like comunism.

      -Liberal democracy-constitutional democracy-representative democracy(The USA federal government and indivdual States, japan, mexico, brazil, argentina)-the politcal theory that the people vote to control who repersents their interest in matters of the state. Then those repersentive are then controled by a superior law that then controls their actions in their representation of the the people. It is a majority rule society were government officials are subjuct to the law and the people.

      -Our federal government is made up indivudual soverign states that makes the US technically a decentrlized country. Power is closer to the indivdual because it was recognized that have concentrated power would cause a power shift of larger states leaving smaller states to the way side. This is why in the senate there are two from each state to repersent the state governments interest thats also why they used to be appointed rather than voted in. The house of rep. is used for the induvidule citizens rep. Our federal system as originally drawn up gives the federal gov. certain number of rights and duty to protect individual and left the rest to the individual states. ex. interstate commerce(fed right), Marrage(state right).

      – Pure Capitalism= an Economic Theory that consumers have all the say in what they sell and or buy. No government control is in the market consumer decisions control what is made or not made. If profit could be made it will be produced. Consumer controls also control the regulation because bad product will be not be bought over good products. The problem people have is that some profit greatly while others fail. But to the bare bones of it is survival of the fittest.

      Sorry longer than it should be, but I hate when people back up arguement with the wrong and mis-guided definition.

      ^Yes, as unfortunately true that may be, any real American who loved his country and respected his rights would never burn his own country’s flag. If he ever is needing of a reminder why he shouldn’t burn his own flag then he should ask the men, women, and families of fallen soldiers who have defended all our rights even the right that allows one to burn a flag if they so choose to do so.

      God Bless this Country and those who have fought to defend it.
