Las Vegas Raiders cornerback Nate Hobbs was arrested for DUI just a few hours after a win over the Colts — a win that keeps the team in the playoff chase — and police told TMZ that the rookie was found passed out in his car.

The ‘passed on in his car’ is doing a heavy lift in semantics, at least that is what his attorney is arguing.

“The facts and circumstances related by the Las Vegas Metropolitan Police Department to the news media leave serious concerns that this does not qualify as a DUI under Nevada law,” David Chesnoff and Richard Schonfeld told the site.

Rich Bisaccia, the interim coach for the team, said that he and the team were made aware of the arrest but have not determined if he will play in the Week 18 game.

“We’re just trying to collect as much information as we possibly can on what exactly happened and what the situation is and where he’s at with that,” Bisaccia said.

TMZ also reports that police responded to The Cromwell Hotel around 4 in the morning on Monday, and that witnesses saw Hobbs asleep at the wheel, on a parking lot exit ramp.

Hobbs was booked on one count of misdemeanor DUI and reportedly has a court date set for May.
